These Terms of Service (hereinafter referred to as the "Terms") define the conditions of use for the WordPress plugin "QuikVox AI" (hereinafter referred to as the "Service") provided by Takeshi Uematsu (hereinafter referred to as "we", "us", or "our"). By using the Service, you (hereinafter referred to as the "User") agree to these Terms.
These Terms apply to all relationships involving the use of the Service between the User and us.
1. The Service provides a WordPress plugin incorporating an AI function that converts text data into audio data.
2. We grant the User a non-exclusive, non-transferable, and non-sublicensable right (license key) to use the Service.
3. The default subscription validity period is one year from the date of purchase, and it is automatically renewed annually (subscriptions including the Business plan are also subject to this rule).
1. As consideration for the Service, the User shall pay the usage fees separately determined by us via credit card payment processing through Stripe.
2. Unless the User completes the cancellation procedure by the specified method, the subscription will automatically renew under the same conditions, and billing will occur.
3. Due to the nature of digital content (downloadable plugins and license keys), as a general rule, we do not accept refunds, returns, or cancellations after purchase.
The User shall not engage in the following acts when using the Service:
1. Acts that violate laws, regulations, public order, or morals, or acts that may cause such violations.
2. Acts of using the generated audio data to infringe on the rights of third parties (copyrights, portrait rights, privacy rights, honor, etc.).
3. Acts of generating or publishing deepfakes, spoofing, scams, slander, or other malicious content.
4. Acts of transferring, selling, lending, or illegally sharing the granted license key to a third party.
5. Acts that impose an excessive load on the servers or APIs for providing the Service (such as scraping or unauthorized continuous API requests).
6. Acts that may interfere with our services or operations.
7. Any other acts that we deem inappropriate.
1. We may suspend or interrupt the provision of all or part of the Service without prior notice to the User if we determine that any of the following apply:
2. We shall not be liable for any disadvantage or damage incurred by the User or a third party resulting from the suspension or interruption of the provision of the Service, regardless of the reason.
1. We make no guarantees regarding the accuracy, naturalness, or fitness for a particular purpose of the audio data generated by the Service.
2. We shall not be liable even if the functions of the Service are restricted or suspended due to sudden specification changes, suspensions, or termination of external APIs (such as Gemini API, etc.).
3. We shall not be liable for any direct or indirect trouble or damage caused to the User through the use of the Service. However, this does not apply in cases of intentional or gross negligence on our part. In such cases, the maximum amount of damages shall be limited to the usage fees for the Service paid by the User to us over the past year.
The User can cancel the automatic renewal of the subscription at any time through their account settings (customer portal). Even if the cancellation procedure is completed, the User may continue to use the Service until the already-paid period expires.
We may change these Terms at any time without notifying the User if we deem it necessary. The revised Terms shall become effective from the time they are posted on this website, and Users who use the Service after the change shall be deemed to have agreed to the change.
The interpretation of these Terms shall be governed by the laws of Japan. In the event of a dispute regarding the Service, the court with jurisdiction over our location shall have exclusive agreement jurisdiction.
